1. Acknowledgement of Risk

I understand that participation in martial arts and combat sports such as Brazilian Jiu-Jitsu (BJJ) and other martial arts involves inherent risks. These include, but are not limited to, joint locks, chokes, takedowns, strikes, close physical contact, fall and use of training equipment and facilities.

These activities may result in minor injuries (such as bruises and soreness) or serious injuries, including sprains, fractures, torn ligaments, head trauma, or in rare cases, permanent disability or death.

2. Assumption of Risk

I freely and voluntarily assume all risks associated with training at Stance Jiu-Jitsu Academy, whether foreseeable or not, including those arising from the actions or negligence of instructors, staff, or other participants.

3. Medical Fitness Declaration

I confirm that I am physically and medically fit to participate. I have disclosed any medical condition that may affect my ability to train, and I have consulted a healthcare professional if necessary.

4. Waiver and Release of Liability

I hereby waive, release, and discharge Stance Jiu-Jitsu Academy, its owners, directors, instructors, staff, affiliates, agents, and fellow participants from any and all claims, liabilities, demands, or causes of action arising from or related to participation, except where caused by gross negligence or willful misconduct.

5. Parental Consent (for Minors)

If the participant is under 18, I confirm that I am the parent or legal guardian and accept full responsibility for the minor’s participation and all associated risks.

6. Health & Safety Compliance

I agree to comply with all safety instructions, hygiene standards, and training protocols. I understand that failure to do so may result in suspension or removal from training.

7. Media Consent (Photos & Videos)

I consent to the use of photos and videos of myself (or my child) taken during training or events, for use by Stance Jiu-Jitsu Academy for marketing and promotional purposes. I understand I may opt out by providing written notice.

8. CCTV Notice

I acknowledge that CCTV cameras are in operation 24/7 in training areas for safety and security. I accept that training sessions may be recorded.

9. Jurisdiction and Severability

This agreement shall be governed by the laws of England and Wales. If any provision is deemed unenforceable, the remaining provisions shall remain valid and in effect.

10. Understanding and Voluntary Participation

I confirm that I have read and understood this agreement, had the opportunity to seek legal advice, and am signing voluntarily. I understand that this waiver is legally binding.

In providing our space and services, Stance Jiu Jitsu Academy is dedicated to ensuring that no customer, member of the public, or Stakeholder is subject to unlawful discrimination.

Purpose of This Policy:

• Promote equality, fairness, and respect for everyone in our community.

• Provide a welcoming, inclusive space free from discrimination.

• Eliminate any form of discrimination under the Equality Act 2010, including the protected characteristics of:

  • Age

  • Disability

  • Gender reassignment

  • Marriage and civil partnership

  • Pregnancy and maternity

  • Race (including colour, nationality, and ethnic or national origin)

  • Religion or belief

  • Sex and sexual orientation

• Eliminate discrimination based on socio-economic background, ensuring that everyone feels equal, safe, and welcome.

• Actively oppose and prevent all forms of unlawful discrimination.

Our Commitments at Stance Jiu Jitsu Academy:

• Foster equality, diversity, and inclusion as core values in our academy and community.

• Take action to eliminate discrimination, including:

  • Direct discrimination – treating someone less favourably due to a protected characteristic.

  • Indirect discrimination – applying a policy or rule that disadvantages certain individuals unfairly.

  • Bullying – using power to humiliate or undermine others.

  • Victimisation – punishing someone for raising concerns or complaints in good faith.

  • Harassment – unwanted behaviour that violates dignity or creates a hostile environment, including sexual harassment. This may also be subject to criminal law under the Protection from Harassment Act 1997.

All forms of discrimination toward any Stakeholder at Stance Jiu Jitsu Academy will be treated as serious misconduct. Complaints will be taken seriously and addressed promptly and appropriately.

We will continue to:

• Maintain a training environment free from bullying, harassment, victimisation, and unlawful discrimination.

• Promote dignity, respect, and appreciation for differences among all Stakeholders.

• Provide training and guidance to staff, coaches, and volunteers to ensure understanding of their rights and responsibilities under this policy.

• Offer equal opportunities for development and progression, with decisions based on merit and free from bias, except where specific exceptions are legally permitted.

Complaints Procedure:

Any Stakeholder who feels they have experienced unfair treatment under this policy is encouraged to raise the issue through our formal grievance process. All concerns will be investigated thoroughly, and appropriate disciplinary action will be taken where necessary. Anyone submitting a complaint in good faith will not face retaliation. However, knowingly false or malicious claims will be addressed accordingly.

  MEMBERSHIP TERMS & CONDITIONS

  These Terms & Conditions form a legally binding agreement between you (“the Member”) and Stance Jiu Jitsu Academy Ltd (“the Academy”, “we”, “us”). By signing up for membership and or attending classes, you agree to comply with the following terms.

  ---

  1. Payment & Billing

  Memberships are billed monthly via direct debit, with payments processed on the date of your initial sign-up each month.

  Members are responsible for keeping valid and up-to-date payment details on file.

  If your cancellation or freeze request falls within a current billing cycle, membership payments remain due during the notice period and will continue to be collected until the notice period has fully ended.

  Any outstanding balances must be cleared in full before cancellation or freeze can take effect.

  ---

  2. Membership Commitment

  There is no long-term contract. You may cancel at any time with one month’s (30 days’) written notice via email to info@stancejiujitsu.com.

  The notice period takes effect from the date your email is received, not from the last date of attendance.

  Non-attendance does not constitute cancellation and does not exempt you from fees during the notice period.

  Non-Attendance Clause

  Non-attendance does not entitle the Member to cancel, freeze, or amend their membership. All changes must be requested in writing.

  Written notice must be submitted by email to info@stancejiujitsu.com. Verbal requests, text messages, social media messages, or implied requests through non-attendance will not be accepted and will not stop billing.

  This written notice requirement is a legally binding condition of this Agreement and is enforceable under UK consumer contract law, including the Consumer Rights Act 2015.

  3. Late or Missed Payments

  Membership fees must be received in full no later than the 5th day of each month.

  Failure to make payment by this date, without prior written notice of cancellation or freeze, may result in automatic suspension or cancellation of your membership.

  You will not be permitted to train until all outstanding amounts are paid in full.

  Stance Jiu Jitsu Academy Ltd reserves the right to add reasonable administrative fees for late payments and to refer any unpaid invoices to debt collection agencies.

  4. Cancellation & Freezing of Membership

  1. Cancellation by the Member

  Members may cancel their membership at any time by providing a minimum of 30 (thirty) days’ written notice. Written notice must be submitted by email to info@stancejiujitsu.com or through the member portal, where available.

  2. Notice Period & Continued Access

  The membership will remain fully active for the entire 30-day notice period. Members retain full access to all classes, facilities, and benefits until the notice period has expired.

  3. Billing During the Notice Period – Legally Binding Clause

  By entering into this membership agreement, the Member expressly acknowledges and agrees that:

  • If a cancellation request falls within an active billing cycle, membership payments remain due and payable during the notice period.
  • Any scheduled payments that fall within the 30-day notice period will be collected in full, even if the Member chooses not to attend classes during that time.
  • The Member remains financially responsible for all membership fees until the full 30-day notice period has ended.
  • No refunds, credits, discounts, waivers, freezes, or prorated adjustments will be issued for payments processed within the notice period, regardless of attendance or usage.

  This condition constitutes a material and binding term of this Agreement and is enforceable under applicable UK contract and consumer law, including the Consumer Rights Act 2015.

  4. Completion of Cancellation

  No further membership fees will be charged after the 30-day notice period has ended. The membership is considered formally terminated only when the full notice period has elapsed.

  5. Member Responsibility

  It is the Member’s sole responsibility to submit cancellation requests promptly. Failure to provide proper notice may result in additional charges that the Member remains legally liable for.

  5. Bank Holidays, Christmas & New Year Closures – No Refunds

  The Member expressly acknowledges and agrees that:

  • Stance Jiu Jitsu Academy Ltd may close fully or partially on UK Bank Holidays, during the Christmas period, and during the New Year period.
  • Membership fees are calculated on a rolling monthly basis and are not linked to a fixed number of classes, days, or sessions per month.
  • No refunds, credits, discounts, extensions, freezes, or prorated adjustments will be issued for any classes not held or attended due to Bank Holidays, Christmas closures, New Year closures, or any other public holiday closures.
  • Temporary closures during these periods form part of the Academy’s normal operational calendar and are foreseeable and accepted as part of this Agreement.

  This clause constitutes a material and binding term of the Membership Agreement and is enforceable under the laws of England & Wales, including the Consumer Rights Act 2015.

  6. Legal Enforcement of Outstanding Payments

  By agreeing to these Terms & Conditions, you acknowledge that unpaid fees remain due and legally enforceable.

  Under the Consumer Rights Act 2015 (UK), clear cancellation and payment terms such as those set out above are binding on both parties.

  Under the Late Payment of Commercial Debts (Interest) Act 1998 (UK), Stance Jiu Jitsu Academy Ltd is entitled to:
  • Charge statutory interest on overdue sums.
  • Recover reasonable debt recovery and legal costs in addition to the unpaid fees.

  These obligations remain binding even if you stop attending classes.

  7. Governing Law & Jurisdiction

  These Terms & Conditions, and any dispute or claim arising out of or in connection with them, shall be governed by and construed in accordance with the laws of England & Wales.

  The courts of England & Wales shall have exclusive jurisdiction to settle any disputes arising from or related to these Terms.

  8. Acceptance

  By signing up for membership and or attending classes, you acknowledge that you have read, understood, and agreed to these Terms & Conditions, and that all payments are owed directly to Stance Jiu Jitsu Academy Ltd.
